Uncontested Divorce during Abusive Relationship

Are you considering an uncontested divorce? This is a viable option for many couples. If the court believes that there is any type of abuse occurring in the relationship, however, it is likely to be dismissed as a possibility.

When you are in an abusive relationship, discussing your divorce calmly is not likely to occur. In an uncontested divorce, both parties need to be able to feel free to talk about the divorce and the resultant settlement. If one of those parties is too scared to speak up for him/herself, the divorce settlement could be rejected altogether. However, if you are dead set on doing an uncontested divorce and feel that your spouse needs some time to cool down; it may be a good idea to wait a few weeks or months before filing.

If you feel that you cannot talk to your spouse about the divorce, you should seek legal counsel. Get the legal advice you need and deserve from a family law attorney that has experience in similar cases.
