New York Judge Orders Couple To Sell Contested Homestead
After a long running attempt to get divorced, which was first initiated in 2005, a couple has been granted their no-fault divorce thanks to a recent change in New York law.
Until last year, New York was the only state in the United States to lack a procedure for a no-fault divorce, requiring that one or both partners have committed some sort of ‘fault’ such as infidelity against the other. The bill creating no-fault divorce was signed into law in August 2010. The couple in question, who had filed for divorce in 2005, had their request rejected by the jury because neither would admit to a ‘fault’. This change in the law, however, finally allowed their petition to go through.
Couple Built Wall In Home
As part of the deal, however, the Judge in the case ordered that they sell their contested Borough Park home, which neither party would concede. Now, they will be required under court order to sell their home and split the proceeds, a decision with which the wife says she is unhappy and intends to appeal.
When she kicked her husband out of their home in 2005, a Brooklyn judge ruled that, since they couldn’t be divorced without one partner admitting fault, the husband could move back in provided they built a wall to divide the home in two. Construction of the wall was completed in 2006, dividing the house between the wife, who lived on the third floor and part of the second, and the husband, who got part of the second and the first floor.
