An annulment differs from a divorce in that it basically makes it so the marriage never occurred from a legal standpoint. When a marriage is found to be non-valid then there is no need to go through many of the complications that may be part of a divorce. A California resident has up to four years from the date of the marriage to file an annulment petition. The petition must clearly show that there are valid grounds for an annulment or it may be summarily denied. Conditions which may make an annulment possible include physical or mental incapacity at the time of the marriage, fraud, coercion, an incestuous relationship, bigamy, one or both individual entering into the marriage were underage and other similar circumstances. One of the most common grounds for an annulment is when a spouse does not disclose a physical condition or tries to hide financial circumstances or other situations. Other such cases include a marriage that took place under the assumption that a child is theirs when paternity tests later show differently. Likewise, a partner that does not disclose a known illness or disease such as AIDS, cancer, mental problems or a condition that prevents him or her from having children at the time of the marriage is grounds for annulment. These cases and anything similar may be considered fraud or deceit by the court.
