The Supreme Court Rules on Child Support Issues

Last year in a case labeled the “deadbeat dad”, the Supreme Court made a ruling concerning a father who was not allowed free legal representation when found in contempt of court for not paying child support. The man was found to be in contempt several times, owed approximately $6,000 in payments, and wound up in jail for 12 months. He had no money and no job, making it impossible to pay the child support arrears. The Court ruled that individuals who do not pay child support are not entitled to free legal representation. The Court further stated that such individuals cannot be sent to prison for child support failure without being given the opportunity to show evidence of their financial status. If the courts determine that they have the means to make child support but are simply refusing to pay, they are then liable for prison.
