If you're thinking about divorce, there's a good chance that your husband or wife has entertained the idea too. Here are some tips about knowing your rights when it comes to spousal support, child support and dividing the marital assets. By doing a little research, you'll soon realize that you're not as powerless as you may feel.

  • Divorce proceedings can be like war in many cases, so prepare for battle.
  • Before you file, consult with three or more attorneys in your area about their fees.
  • Talk with your accountant to learn about the financial consequences of divorce.
  • Think about the timing of your divorce. It may be worth it for Social Security or spousal support purposes to wait until it's been 10 years.
  • Once you decide to get divorced, be the one to file first. You'll be at an advantage.
  • Before telling your spouse, get copies of all financial documents, including: taxes, bank and credit card statements, mortgage loan documents, deeds, and life insurance policies etc.
  • Track down each asset; you want to know where every penny is.
  • Start protecting your credit today, and don't co-sign for your spouse.
  • Stash some cash, you're going to need it. Just think, your spouse may already have money tucked away somewhere.
  • Dust off that old resume; even if you're entitled to alimony, it won't last forever.
  • Don't sabotage your spouse's relationship with the kids, judges hate it.
  • Document any abuse, you're going to need it, especially as it applies to child custody and support.
  • Don't believe what your spouse says about you ending up with nothing or losing the kids. Your spouse doesn't make any of these decisions, the judge does. Half of the marital assets belong to you.
