When the Court Seeks a Legal Guardian

There are times when the courts will ask that a guardian step forward to care for a child. In these cases, judges prefer to pick someone that already has a relationship with the child. As a legal guardian, you will be responsible for the well-being of the child. This can include taking care of the child's needs of shelter, food, education and medical attention. Therefore, a judge will seek out someone such as a parent, relative or a state employee that has already established a relationship with the ward. While someone can be recommended to the court to be a guardian, that person is not obligated to accept the role of guardian.

However, should that person decide to become a legal guardian, it is a task that cannot be taken lightly. The court must approve the legal guardian as well. This is done after reviewing the individual's personal history including physical health, financial stability and character. If you have questions related to guardianship or child custody take the time to speak with a family law attorney in your area.
