What is a Collaborative Divorce?

There is a newer way to handle dispute resolutions in family law and it is called collaborative divorce. The lawyers representing both clients agree to use cooperative techniques to assist their clients, rather than litigation and adversarial strategies. Both parties are resolved to reach a negotiated agreement instead of fighting with one another. In fact, litigation is simply not allowed during this type of divorce settlement.

A "participation agreement" is entered into by both parties beforehand, which state that if a settlement cannot be reached, the lawyers will be allowed to excuse themselves from the divorce proceedings. Their clients will then be allowed to enter into the litigation process; the lawyers' retainer fees will only cover the settlement negotiations if this occurs.
