Atlanta May Offer Lawyers to Parents Behind on Child Support

Parents who are in danger of being jailed or have already been jailed for failure to make child support payments may soon be getting the legal help they need. Thanks to the efforts of a civil rights group in Atlanta, delinquent parents could get the lawyers they cannot afford through a class action lawsuit.

The suit, filed in the Fulton County Superior Court last Tuesday, is on behalf of six parents who were unable to make child support payments due to the difficult economic atmosphere. A few of these parents have already been placed in jail for late payments.  They are all represented by the Southern Center for Human Rights who has been working hard on their case.

The basis of the lawsuit is that under Georgia law the authorities don't have the right to jail these parents who are unable to make their payments. It is a catch-22 situation in that the parents do not have the money to pay a lawyer, and they need a lawyer to prove that they are indeed indigent.
