Things to Consider Before a Prenup

While getting married is exciting there are several items that you need to consider before saying "I do." One of these items is whether or not to sign a prenuptial agreement with your future spouse. If you are considering this legal route then you must understand what is covered by a prenuptial agreement.

Depending on the state you live in and your personal circumstances prenuptial agreements can vary from person to person. However, these are some common items that are covered: each spouse is protected from debt; an outline of which spouse would receive what property; making sure that children will receive the property they are owed; whether taxes will be filed separately or jointly; who will pay for family bills and how retirement benefits are allocated.

It is important to remember that in the case of a divorce, if you have not signed a prenuptial agreement, a judge will determine how your property is divided, not you. That is why some couples decide to make the agreement beforehand in order to maintain more control over these decisions should a divorce situation arise.
