Getting Alimony in Florida

In the state of Florida, a spouse that is considered "dependent" may seek alimony (also known as spousal support) on a permanent or rehabilitative basis.  Before the court will award alimony to a dependent spouse, it will closely consider the following:

§  the standard of living that was established throughout the duration of the marriage

§  the length of the marriage

§  both spouse's earned income and availability of income

§  the age of each spouse

§  the physical and emotional well-being of each spouse

§  how assets were distributed

§  the role of each spouse throughout the marriage (i.e. was one spouse the home maker or was one spouse the bread winner)

After all of these factors have been carefully reviewed, the court will decide whether or not awarding spousal support is appropriate.
