Divorce can either be contested or uncontested. When spouses agree to divorce one another, and they also agree on the terms of their divorce, this is considered an uncontested divorce. In order for a couple to go through with an uncontested divorce, both spouses must agree to it. If one party does not adhere to the principles, the couple must file for a contested divorce.

Uncontested divorces tend to save potential divorcees much time and money as the process is less complicated and does not require court intervention. If a couple is able to avoid going to court, they will save both a large amount of money and also great emotional strain. The divorce process is also generally faster in uncontested divorce, since the spouses can discuss any pressing issues without waiting on an intermediary.

By negotiating their own divorce terms, spouses often have less conflict with one another. Uncontested divorce is practical insofar as both spouses are in agreement and are willing to collaborate. Even though spouses may agree on divorce terms, it is still in their best interest to retain separate attorneys to ensure that their rights and best interests are protected.

Inconveniences of Uncontested Divorce

While uncontested divorce may save money and time, it can also be less efficient. Issues surrounding child custody can be complicated, and an attorney may be needed to work out the details. Dividing or allotting property can also be an issue that is too complicated for spouses to work out independently. In such cases, it may be worthwhile to file for a contested divorce so that the spouses can maximize their time. If a couple cannot negotiate on issues surrounding divorce, it may be in their best interest to file for a contested divorce.
