When couples get a divorce, they might think they have it all figured out, all the way down to what’s going to happen in the upcoming years. The truth is, circumstances change. The only thing in life you can really predict is death and taxes right? Divorcing couples can’t always predict what the future will bring. Perhaps “Dad” had a really good, stable job with benefits that he later lost because the company went bankrupt. Or, on the other hand, perhaps he went back to school after the divorce and wound up earning significantly more money after receiving a fancy degree. If Mom got the kids, both situations would warrant an adjustment in child support, either a downward modification or an upward modification of support.

Modifications can affect child custody and visitation too. It might seem like the kids will stay with whichever parent the divorcing spouses agreed upon, but even that can change down the road. For example, if the kids stayed with the mother because she had been a stay at home mom; perhaps a few years after the divorce she becomes terminally ill with cancer, or developed multiple sclerosis and could no longer care for them. Or perhaps she developed an alcohol dependency or a substance abuse problem. Both situations would warrant a change in the child custody agreement. Furthermore, sometimes as children grow older, they realize they get along better with one parent over the other, and it’s their choice to move in with the other parent.
