Do You Qualify for an Annulment?

Annulment Misconceptions

There are many misconceptions concerning when a marriage annulment can be obtained.  If you are considering a separation from your spouse, it is necessary to learn about your options.  It is possible that you can get an annulment to your marriage and avoid messy divorce proceedings.  An Orange County divorce lawyer may be able to help you with your questions and in determining what is in your best interests.

An annulment is a ruling made by a judge that a marriage is not in fact a valid marriage.  An annulment can be more difficult to obtain than a divorce and has strict qualifications.  Some people prefer to get their marriage annulled rather than seeking a divorce for financial reasons.  In an annulment, there is no automatic negotiation for spousal support or alimony.  It will be as if the marriage had never taken place. Circumstances may differ when children are involved.

Annulment Time Period

Contrary to what you may hear about those quick Vegas weddings, the period of time a couple has been married doesn't necessarily have any bearing on whether or not an annulment will be granted.  A quick wedding may be in perfect legal order so other circumstances would have to be present to render the marriage invalid.  In California, an annulment can be filed up to four years after the marriage date.

There are many reasons people may seek an annulment.  Failure to meet legal requirements for marriage include circumstances such as age or failure to obtain parental consent, no witnesses, no blood tests, the couple is too closely related by blood, or there is a previous marriage that was still legally current. Personal or criminal reasons can come into play such as coercion, misrepresentation, non-disclosure of criminal history thought to be crucial knowledge, mental incapacity, inability or refusal to engage in sexual intercourse and more.  Ultimately, it is up to the court to determine the facts of the case and make a decision on whether or not an annulment is in order.
