Contested and Uncontested Divorce

By Perez & Cedeño  Oct. 27, 2010 10:40a

The ideal resolution to the end of a marriage is an uncontested divorce. It is less expensive, less time-consuming and generally results in at least both individuals parting with less stress or bitterness. In order to avoid a contested divorce both parties must work out and agree to all of the important issues regarding the division of property or assets, child custody, visitation and child or spousal support issues. The advantages of an uncontested divorce are:

  • A significantly shorter timeframe than litigated divorce in court
  • Fewer expenses
  • Allows for maintaining a friendly relationship
  • Less emotional trauma for children involved
  • Avoid the stress of court
  • Retain freedom to make unique decisions about property, custody and support instead of adhering to judicial decision

When spouses cannot come to an agreement on the terms of their divorce the result is a contested divorce. In a contested divorce the parties involved must take their case to a Supreme Court judge who will rule how the division of assets, custody and support is to be followed in order to resolve the divorce. It is very important to contact a New York divorce attorney if you have a contested divorce. In high net worth divorces and divorces involving children it is especially important to have proper representation so that each side is presented fairly before the judge. Unfortunately, contested divorces often result in hostility, much higher expenses, and a longer, more time-consuming process, but sometimes not all issues can be agreed on and legal intervention is the only option.
