Facts About Uncontested Divorce

Florida is a "no fault state," which means a partner can file for a divorce without some form of abuse being the grounds for divorce. Having irreconcilable differences can be sufficient grounds and this makes divorce an easier option if the marriage is not going well. In order to have an uncontested divorce, a marital separation agreement is needed and a brief hearing is also part of the process.  It does not require a judgment be delivered in the court. One of the advantages of uncontested divorce is that it allows partners to remain more flexible and set their own terms as opposed to a judge in family law court ordering something that you may not entirely agree with.

At least one of the partners needs to have resided in the state for at least six months prior to filing for divorce and the filing should be done in the defendant's county where he or she resides or in the county where the couple both last resided together before separating. The whole process can take as little as thirty days.

Uncontested divorces are normally done when a couple has no disputes occurring regarding the divorce or the arrangements or terms. Couples who have no particular assets to divide or fight over and who can easily make arrangements with children, whether it be custody decisions or child support, are prime candidates for uncontested divorce.
