When couples with children get divorced,
child custody, visitation and
child support matters are very sensitive issues that have to be addressed. From the outside, handling such matters may seem simple and matter of fact; however they can be very upsetting for those involved. If you are getting a divorce, it's extremely important that you contact a
divorce attorney who can represent you and your interests in a child custody matter.
In Florida, when the court looks at the facts of a child custody case, it will make every attempt to provide a shared custody arrangement for the children when both parents are deemed fit. However, not every child custody case is cut and dry. There may be issues regarding one or both of the parents, where they may not be suitable to share custody of the children; for example, if one parent has a drug or alcohol problem, or if they have abused the children or the spouse, they may not be awarded shared custody of the children, because doing so, may pose a threat to the health and safety of the spouse and the children. When the court is making a determination as to child custody and visitation in a divorce proceeding, they will consider the following:
- The moral fitness of both parents
- The child's home, school and community record
- The child's preference
- Evidence of domestic violence or child abuse
- The parents capacity to provide food, shelter, clothing and medical care for the children
- The child's relationship and closeness with one or both parents
- The willingness of both parents to allow and encourage contact with the non-custodial parent
- Any other important information that would be relevant to the child custody arrangement
