Child Custody Laws in Florida

Child custody and visitation remains a primary topic and area of concern in every  divorce involving minor children. The state of Florida does not automatically award custody to the mother in a divorce. When the court makes a determination about child custody in a divorce, it does so in accordance with the Uniform Child Custody Jurisdiction and Enforcement Act.

In accordance with this act, the state of Florida actively pursues a custody arrangement that promotes a healthy relationship, where both parents play an active role in raising their children after the dissolution of their marriage or a separation. The courts primary focus when considering the facts of the case will always be; what is in the best interests of the child. For this reason, fathers are given the same consideration as mothers when determining which parent will get primary custody of the children. When both parents are responsible and fit to care for the children, the court will order that custody be shared by both parents. However, when the court determines that a shared parental responsibility would be detrimental to the child, or if the parent has been convicted of domestic violence, shared parental responsibility may be denied to that parent. If this occurs, the parent who is denied shared parental responsibility is not relieved of their obligation to pay child support to the custodial parent.
