North Carolina Child Support

In North Carolina, child support terminates when the child reaches the age of eighteen. However, there are exceptions to the rule. The first case would be when a child otherwise emancipates prior to turning 18 and, the second scenario would be when the child is still in high school. If the child remains in high school after his or her 18th birthday, then the payments could continue until the child reaches the age of 20, unless the court makes an order stating that the
child support payments cease at age 18 or before high school graduation.
Ideally, child support matters are handled directly by the parents, however when parents cannot come to an agreement on child support matters, they may need to enlist the services of a Raleigh family law attorney; this is especially true in divorce proceedings. When couples are getting a divorce, child support can be settled in a separation agreement.
Actions for child support (initial declaration or modification) have to be brought in the county where the parent or the child calls their residence, or in the county where the child is physically located.
Child support in North Carolina is calculated based upon the income of each parent, which may include IRA’s and stock options. Child support is never fixed in stone, until the child turns 18, either party can petition the court for a child support modification. Changes in circumstances for either parent can make a child support order go up or down. For example an increase in income or a job loss for either parent can affect child support. The burden of proof will be on the petitioning parent to show that there has been a “significant” change in circumstances.
