The Value of Post Divorce Modifications

Life is filled with constant change and we must remain flexible to accommodate changes that are sometimes unexpected or that we have little control over. When changes do occur that make it necessary to modify previous divorce agreements, a legal process called a modification needs to be constructed and submitted to the court. It does no one any justice to keep an agreement as originally written, if the terms of that agreement can no longer be kept with justified reason. These changes or modifications can address financial arrangements for
child support or
alimony. Numerous other areas can be addressed as well including the following:
Changes That Can Require Modification
- If a spouse needs or desires to relocate and the children would also be included, you have the legal right to oppose the move or make changes in the visitation agreements.
- If a spouse who is providing spousal or child support has a change in income and it affects their ability to make the agreed upon payments, this can be addressed in a modification.
- If a spouse has a significant increase in income, an increase in child support or spousal payments can be arranged.
- If an asset or some form of property was not included in the original property settlement divorce agreement, but should have been, this can be modified.
- If the parent who has physical custody of the child has a change in his ability to be a responsible caretaker of the child or children, a petition can be submitted to the court to change the custody and visitation arrangements.
- If the child now requires changes, these also can be addressed in a modification which may affect child support or visitation agreements previously made. For example, some medical situation may have arisen that changes the living situation.
