Collaborative Divorce: The Friendlier and More Cost Effective Way

Many divorces can be difficult, contentious and down right bloody if the spouses are at odds with each other. When this type of activity occurs, the divorce can be more costly, drawn-out and emotionally painful for not only the couple, but for any children involved.
It can quite often be harder on a child as the two people they have looked up to for stability and guidance are now not so stable. Collaborative divorce is a better and far less painful solution if the couple can work more toward common agreements to bring about the divorce.
What is a collaborative divorce?
Both partners have an attorney who assists their clients to come to amicable solutions regarding the divorce. Discussions are usually done in person and are geared toward resolving differences and conflicts so as to negotiate outside of court. Instead of litigation and battling in a court room, good communication and cooperation is emphasized. The goal is to achieve negotiations that both can agree with and a participation agreement is signed by both parties.
The agreement will normally state that if amicable solutions cannot be reached through the collaborative process, then the attorneys will withdraw and a new arrangement will be made whereby the couple can hire trial attorneys to settle the differences in court. Other agreements in a collaborative divorce might address issues such as communication should be constructive and fair, not upsetting and vicious, that neutral outside professionals may be utilized to help sort out financial matters, and so forth.
