Important Facts About Adoption In Florida

By Fritsch Law Firm  May. 16, 2011 10:04a

There are many reasons why people adopt children and there are different types of adoption as well. A couple may have been unable to overcome fertility issues, they may already have biological children but want to extend the family through adoption or, may just want to adopt and not have any of their own biologically. There are even circumstances where a single person wants to adopt a child to build a family. Following are some basic facts about adoption in Florida:

  • A married person can adopt a child without the other spouse as long as the spouse's failure to consent is waived by the court.
  • If a step parent wishes to adopt a child, he may do so without his spouse as long as the spouse consents to the adoption.
  • It is against Florida Law for homosexuals to adopt a child
  • A person cannot be denied the right to adopt if they are handicapped unless it is determined by the Department of Children and Families that the handicap would prevent them from actually being able to carry out the duties and responsibilities of being an effective parent.
  • There is no age limit in the adoption process but one does have to be of legal adult age.
  • There are different types of adoption that are available namely domestic infant adoption, older child adoption, international adoption and special needs adoption.
  • You will be required to go through a screening process to determine your suitability for adoption and to ensure you are cleared legally as well. Background and financial checks will be done and an adoption study worker will meet personally with you and your family. You will be asked many personal questions and this applies to any type of adoption you wish to pursue.
