California Uncontested Divorce

While we may think that most divorces are like the ones we see in movies and on TV where spouses pit themselves against one another in a hostile courtroom battle, many divorces can be accomplished in a relatively amicable way. Experts agree that a divorce done through mediation or collaborative law is less expensive, less time-consuming, and, most important, less stressful. That is because the spouses do not become courtroom combatants but negotiators who try to work things out through cooperation, communication, and problem-solving. This divorce style takes much less of an emotional toll on the spouses involved as well as their children. They also remain in control of the outcome through devising the terms of their divorce agreement between themselves as opposed to the intervention of a divorce court judge.

When two spouses can agree on such matters as child custody and visitation, the division of marital property and debts, and alimony, the divorce is considered to be uncontested. They may do this with the guidance and counsel of their attorney but no litigation takes place. A divorce agreement is drafted and is then submitted to the court for approval. In some uncontested California divorces, a summary dissolution may be obtained. This is a quick divorce where you may never see a judge. The qualifications for such a speedy divorce are a marriage of less than five years duration, having no adopted or natural children, no real estate holdings, having less than $6,000 in marital debts and less than $40,000 in community property or separate property, and agreeing that no spousal support will be sought. The two spouses must sign an agreement that divides their property.
