Is Divorce Mediation Right for You?

Mediation is one option divorcing couples have when faced with working out important issues between them. Mediation allows both spouses to maintain control of their lives and their future as it relates to their divorce. Mediation is especially beneficial for divorcing couples who have children, as it opens the doors to communication in the present and in the future. Statistically speaking, mediated divorce settlements have a higher rate of compliance due to the fact that the husband and wife came to the divorce agreements on their own, as opposed to having them decided for them by an arbitrator or a judge.
A family law mediator is a neutral third party who is specially trained to help couples come to agreements on important issues relating to their divorce. The couple will meet with the mediator in a series of short sessions, ranging from one to two hours long. During the mediation process, the mediator will provide an open forum where both people will be allowed to communicate about their concerns, desires and goals in the divorce. Each spouse will have ample opportunity to speak their mind, and each spouse will be expected to listen to one another’s issues. Additionally, the mediator will be there to provide information about the legal system, how issues are handled by lawyers and judges and offer alternatives for any differences that might arise.
Once the couple has covered all areas to be addressed in the divorce, the mediator will draw up an agreement for each spouse’s family law attorney to review. Once the review is complete, the attorney can file the necessary papers with the court which commence the dissolution of marriage action. Shortly thereafter a judgment will be made, based on the agreement and filed with the court. The judgment based on the agreement will be equally enforceable as any other judgment made in the family court.
