California was the first state to incorporate the concept of “no fault” into divorce proceedings. As the original pioneer of this type of divorce, it replaced earlier fault-based only divorce actions with the no fault grounds of irreconcilable differences. This was signed into law by then-Governor Ronald Reagan under the Family Law Act of 1969, which went into effect on January 1, 1970. This type of divorce proceeding eliminated the need to prove that one of the spouses had engaged in some type of wrongdoing against the other, such as adultery or mental cruelty.

A no-fault divorce recognizes the fact that most marriages fail due to actions or inactions on the part of both partners. Thus, neither party in a no-fault divorce is punished for his or her behavior and an equitable distribution or arrangement of financial and other matters is sought. Because California is a community property state, marital property and assets are divided in a 50 – 50 arrangement as much as possible. A no-fault divorce doesn’t hinge on blame, giving it another advantage in that it makes for a less adversarial procedure. No-fault divorces in which both parties come to an agreement concerning issues which must be resolved for a final decree often do not entail any type of courtroom litigation.
