With a current divorce rate of approximately 50%, more people are taking advantage of the many benefits that prenuptial agreements may have to offer. Prior to 1970, prenuptial agreements were invalid in Florida. Changes in the laws were introduced not long afterwards as divorce became more common and prenuptial agreements were honored. The groundwork was laid for the new law in the case Posner v. Posner, 233 So. 2nd 381, 384 (FL1970).

When couples first take their wedding vows, there is usually no thought that the marriage might end in divorce. Life is not always predictable and the unexpected does sometimes happen.
