Changing Your Divorce Agreement

By Brian D. Perskin & Associates, P.C.  Sep. 8, 2011 2:30p

Life is ever changing and as the years pass, sometimes changes need to be made in divorce agreements. You may need to change a child custody arrangement, child support or alimony agreement due to some change that has occurred in your life. What has to happen now is communication with the former spouse and you will need the help of an attorney to create a "modification" in the divorce agreement. The changes will then need to be submitted to the court for your protection and for legal purposes.

What Steps Must be Taken

If you are the one in need of a post-divorce modification, keep in mind that it will be up to you to provide proof to the court that the reason for the changes are legitimate and significant enough to warrant the change. You may have lost your job, or had to accept a cut in pay requiring that you re-adjust your spousal or child support payments. These things will have to be documented.

Child custody arrangements may need to be modified due to some change in the family environment in your life or your former spouse's. Any changes the original divorce agreement will need to be drawn up in a specific legal document and submitted to the court; an attorney can ensure this is done correctly to protect your individual and family rights.
