False Accusations Made in Restraining Order Case

Be careful of making false accusations: they could cost you.

Earlier this year a graduate student at a veterinary school in Louisiana claimed that one of her professors had sexually abused her. She filed a police report stating that on October 26, he entered her apartment against her will. When she filed for a restraining order against him, the young woman also claimed that he sexually harassed her at work.

When you file a restraining order, the burden of proof is on you to show that harassment is taking place. However, the young woman was not able to show any proof of the harassment at work. Since there was not any sufficient evidence to show either the stalking or sexual harassment that the young student claimed, the judge did not renew the restraining order. Instead, he ordered the student to reimburse the former educator for his various court fees.
