Divorce and Child Custody

Are you planning on filing for divorce? Do you have children? If so, you need to understand now how custody works before you proceed.

When children are involved in any divorce settlement, the parents will need to decide who will get custody. In some cases, both parents will want and be able to support custody of the children. If this is true, then the parents will ask for joint custody. However, this is not always available to divorcing couples as one parent may not be able to support the children on his/her own.

In most cases, one parent will be given primary custody of the child, the "custodial parent", while the second parent, or the "noncustodial parent" will have visitation rights with the child. Depending on the schedule and availability of the noncustodial parent, he/she will usually see the child once or twice a week, as well as on the weekends.
