Is Annulment an Option?

If you are considering a divorce, you may also be curious about how to get an annulment. Depending on what state you reside in, there will be different requirements to get a civil annulment.

In most states, however, there are two conditions that generally provide grounds for a legal annulment. The first, fraud or misrepresentation, is a serious charge that, although difficult to prove at times, will almost always wind up in annulment. Fraud can be represented in many ways, such as if a partner lied about his/her ability to bear children or if the partner was already married to someone else.

The other reason that is often granted an annulment is concealment. When you discover that your spouse lied about something important - such as a drug addiction, a sexually transmitted disease or a felony conviction - you can argue for annulment. Should your partner refuse to have intercourse with you, or cannot have intercourse, you may also be able to argue successfully for an annulment.
