Step Parent Adoption Process

Although it isn't as common, it is possible to complete a step parent adoption if you go through the appropriate legal channels.

The most important step to obtaining adoption papers is to get the legal consent of both your spouse and the child's other parent.  This means that the noncustodial parent gives up all his or her rights to parenting that child, as well as responsibilities like child support. It can also make it more difficult to get the adoption approved if the noncustodial parent does not want to give up his or her rights.

Depending on what state you reside in there are different ways to obtain parental consent. While some states allow a written consent to be entered in court, others require all parties to be present in court to finalize the procedure. There are even some cases when the other parent does not need to give their consent, however, before you attempt to gain or eschew consent, you should consult a family law attorney to learn more about your state's rules.
