While not all couples will opt for a prenup, there are certain cases in which you should really consider signing one. If you own a business prior to getting married, you may want to ask your partner to sign a prenup to protect your own assets. The same goes for anyone that owns real estate or other property that they would want to keep in their own name in the case of a divorce.

When asking your partner to sign a prenuptial agreement, you want to give him/her as much time as possible to review the terms of the document. Do not present your partner with the document just a few days before your wedding or else its validity could be challenged in a court of law.

When you are finally ready to create your prenuptial agreement, you'll want to enlist the services of a family lawyer as soon as possible.
