Texas Rules Against Same-Sex Divorce

In October 2009, a state district judge ruled that two men who were married in Massachusetts and then tried to obtain a divorce in the state of Texas could legally terminate their marriage.  As part of the judge's ruling, she said that the state's prohibition against same-sex marriage violates the federal constitutional right to equal protection.

However, this Tuesday, and Apple a court in Dallas reversed the decision that permitted divorce in the same-sex marriage case.  Justice Kerry P. Fitzgerald wrote, "We hold that Texas district courts do not have subject matter jurisdiction to hear same-sex divorce cases."

Texas Attorney General Greg Abbot interceded in the divorce case and argued that because the state does not recognize gay marriage, Texas courts cannot dissolve one through the divorce process.
