Father Attempted to Flee with Son during Child Custody Case

Don't run from the law because eventually it will catch up with you. A Las Cruces man discovered this first-hand after he attempted to flee with his son after being served with a summons for his child custody hearing. The U.S. Marshalls Service was responsible for bringing the 27-year-old Alabama in to custody last week.

This all happened after Jacob Heath Sells was given a District Court summons from his ex-girlfriend to establish a visitation agreement and physical custody of their 6-year-old son Damien. Sells clearly did not want to grant these to his ex and decided instead to quit his job and call his son's school to inform them that he would not be returning.

Now that Sells has been located, his ex-girlfriend has temporary custody of Damien until the matter has been settled.  Although a summons was issued by a Magistrate Court for Sell's arrest, it now appears that it will be effectively dismissed in favor of a civil case.
