A Dilemma In Texas - Gay Unable To Divorce

Gay couples in Texas are finding it difficult, if not impossible, to get divorced in that state. A recent Judge in Austin did grant one lesbian couple a divorce, however, his decision is being appealed by the Texas Attorney General. At issue here is the fact that gay marriage is not legal in Texas. All couples seeking a divorce in Texas have been married in another state, such as Massachusetts, that allows gay marriage.

This is true of other gay couples across the nation who look to the court to dissolve their unions, many of which include minor children. A Pennsylvania judge last month refused to divorce two women who were married in Massachusetts. But in the same week, in New York, a state that does not allow same sex marriage, a judge granted a same-sex divorce.
Same-sex marriages have families and their families and their children have the same needs as all families, but unfortunately, not the same rights in all situations.
